These Terms of Use (“Terms”) govern your use of our website, online shop, and services. By accessing or purchasing from this site, you agree to these Terms. Please read them carefully.

1. General Use of the Site

  • This website is operated by William Gilkerson | Maritime Art.

  • You must be at least 18 years old or have permission from a parent/guardian to use this site.

  • You agree not to use the site for any unlawful purpose or in a way that could damage or interfere with its operation.

2. Intellectual Property

  • All artwork, images, text, and designs on this site are the intellectual property of the William Gilkerson Estate.

  • You may not copy, reproduce, distribute, or use any content without prior written permission.

  • Purchasing a print does not transfer copyright. It gives you ownership of the physical artwork only.

3. Products & Orders

  • We make every effort to display product colors and details accurately. However, slight variations may occur due to screen settings or printing processes.

  • Prices are listed in CAD or in the country exchange rate that you choose and may change without notice.

  • By placing an order, you agree to provide accurate, complete, and current information.

  • We reserve the right to refuse or cancel any order if fraud or unauthorized activity is suspected.

  • No GST/HST is collected - Gilkerson Art qualifies as a small supplier under CRA rules.

4. Shipping & Delivery

  • All orders will be shipped within 14 days unless notified.

  • Orders are shipped from Nova Scotia, Canada to the address provided at checkout.

  • Shipping times vary depending on destination and carrier. We are not responsible for delays caused by postal services, customs processing, or events beyond our control.

  • Shipping to the United States

    - All art prints made in Canada ship duty-free to the U.S. under the USMCA trade agreement.

    - Prints are classified as art reproductions (HTS 4911.91) and qualify as Canadian-origin goods.

    - We include the required certificate of origin on all U.S. shipments to ensure no import tariffs are charged.

    - Orders are typically shipped via Canada Post / USPS for smooth customs processing and no brokerage fees.

    - Couriers such as UPS or FedEx may apply small customs or brokerage charges beyond our control.

    - Older prints originally produced in the U.S. re-enter duty-free as U.S. goods returned.

    - All shipments include accurate customs documentation and declared value for insurance purposes.

    Other International Orders: Import duties, taxes, and fees may apply depending on your country’s regulations. These charges are the buyer’s responsibility.

  • All shipments are typically insured for the full cost of the print.

  • A tracking number is provided for all shipments.

  • We typically ship with Canada Post, but are not limited to other carriers.

5. Returns & Refunds

  • All sales of prints are final. We do not accept returns or exchanges due to the made-to-order and delicate nature of art prints.

  • If your order arrives damaged or incorrect, please contact us within 7 days of delivery with your order number and clear photos of the issue.

  • At our discretion, we will provide a replacement, store credit, or refund for damaged or incorrect items.

  • Shipping costs are non-refundable.

6. Limitation of Liability

  • We are not liable for any indirect, incidental, or consequential damages arising from the use of this site or the purchase of products.

  • Our total liability shall not exceed the total amount paid for the order in question.

7. Changes to Terms

We may update these Terms from time to time. The date of the latest update will always be posted at the top of this page.
